Welcome to our mobile application (the “App”). This App is published by or on behalf of Syngenta India Limited, a company registered under the companies Act, 1956 having its registered office at Amar Paradigm, S. No.110/11/3, Baner Road, Pune, Maharashtra, India, 411045.

By downloading or otherwise accessing the App, you agree to be bound by the following Terms and Conditions and our privacy policy and our cookies policy. If you have any queries about the App or these Terms, you can contact us by any of the means mentioned in the document. If you do not agree with these Terms, you should stop using the App immediately and uninstall the App.

GENERAL RULES RELATING TO CONDUCT:

The App is made available for your own personal use. The App must not be used for any commercial illegal or unauthorized purposes. When you use the App you confirm to comply with all applicable laws.

You agree without limitation, not to:

Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including copyright or other intellectual property infringement; or
Attempt to gain unauthorized access to the App or any networks, servers or computer systems connected to the App; or
Modify, adapt, translate or reverse engineer any part of the App or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by Applicable Laws.

Indemnify Syngenta and its group companies in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws.

CONTENT:

The copyright in all material contained or available through the App including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other Material is owned by or licensed to Syngenta or its group companies. All rights are reserved. You can view, print or download extracts of the Material for your own personal use but you are not allowed otherwise to copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without Syngenta express permission.

The Trade Marks, service marks, and logos contained on or in the App are owned by Syngenta or its group companies. You cannot use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of Syngenta or the relevant group company or the relevant Vendors of Syngenta.

LINK TO THIRD PARTIES:

The App may contain links to websites operated by Third Party Websites. Syngenta may monetize some of these links through the use of third party affiliate programs. Notwithstanding such affiliate programs, Syngenta does not have any influence or control over any such Third Party Websites and unless otherwise stated, is not responsible for and does not endorse any Third Party Websites or their availability or contents.

Users are advised to access the Third Party Websites/Links at their own discretion and risks.

We take your privacy very seriously. Syngenta will only use your personal information in accordance with the terms of our privacy policy and cookies policy. By using the App, you acknowledge and agree that you have read and accepted the terms of our App.

Personal Data that Syngenta Collects

Personal Data Provided by You

In connection with your use of App, Syngenta may ask you for certain personal data upon registration, or when you use the app, such as your name, email address, telephone number, user name, and password. We also provide the ability for you to post additional content within the App, such as comments or photos, or within your user profile.

Information Syngenta Collect Automatically

Syngenta may collect certain information by automated means when you use the App (“Usage Information”), such as information about the aspects of the App that you use or visit, the time of day you access the App, and how long you spend using the App, mobile carrier, mobile internet browser, the operating system on your Device, and other information described in this Privacy Notice.

The data collected automatically are processed in order to improve the App and to provide you with the best information and services. Syngenta may also collect the mobile device IP address or other unique identifier ("Device Identifier") for any mobile phone, tablet, or other device (any, a "Device") used to access the Platforms. A Device Identifier is automatically assigned to your Device, and our servers identify your Device by its Device Identifier.

The App may contain functionality that collects information about your location, such as via GPS (global positioning systems), your mobile network, or Bluetooth beacon. Location information may be used to verify your location and deliver content based on your location.

How Syngenta Use the Personal Data Syngenta Collects

Syngenta may use the personal data Syngenta obtain about you in connection with the App to:

Provide you with information about the event that you are attending, including via email and push notification on your mobile device;
Enable features of the App, such as attendee lists; posting and commenting functionality; meeting schedules and personalized schedules; "check-ins"; surveys/polls; messaging; agenda sessions; exhibitors; recommendations; content customization; lists of speakers and locations; and notifications and reminders;
Prepopulate App fields such as conference agendas, attendee lists, speakers, exhibitor lists, and meeting location information;
Display content you post within the App to other users of the App;
Create and manage your online account, provide our products and services, and respond to your inquiries;
Communicate with you through the App, by email, or by other means;
Protect against and prevent fraud; unauthorized activity; and claims and other liabilities; and manage risk exposure and franchise quality;
Operate, evaluate, and improve our business (including by developing new products and services; managing our communications; determining the effectiveness of our advertising; analyzing our products, services, and websites; facilitating the functionality of our websites and mobile applications; and performing accounting, auditing, billing, reconciliation, and collection activities);
Assist third parties in the provision of products or services that you request from third parties;
Monitor the use of and improve our interactive assets;
Perform data analyses (including anonymization of personal information) to determine, among other measurements, business performance, number of registrants, channels, and app performance;
Enforce our Terms of Use;
Comply with applicable legal requirements and industry standards and our policies;
Respond to and process inquiries, complaints, disputes; and
Perform auditing, research, and analysis in order to maintain, protect, and improve our services.

Syngenta also may use the information in other ways for which Syngenta provides specific notice at the time of collection.

Location Information: When you use the App and with your consent, Syngenta may collect and use your precise (or GPS) location information collected from the App to enhance your use of the App by providing you with sessions and meetings nearby. Please note that turning off location services may affect certain features of our App.

Photos and Camera: Syngenta will not access your photos or camera without first getting your explicit permission. If you give us permission to access photos or your camera, Syngenta will only use images that you specifically choose to share with us. You may use our application to select the photo or photos you choose to share, but Syngenta will never import the photos you review except those you explicitly share. At any time, you can manage your Photos and Camera preferences by turning off this feature in the Device Settings of your mobile device.

Personal Data Syngenta Shares

Syngenta does not sell or otherwise disclose personal data Syngenta collects about you, except as described in this Privacy Notice or otherwise disclosed to you at the time the data is collected.

Service Providers: Syngenta may share personal data with our service providers who perform services on our behalf, such as companies that develop and support the operation of the App, and send email or other electronic communications. In some instances, these service providers may collect information directly from you on our behalf. Syngenta does not authorize these service providers to use or disclose the data except as necessary to perform certain services on our behalf or comply with legal requirements. Syngenta require these service providers by contract to appropriately safeguard the privacy and security of personal data they process on our behalf.

Other App Users: The App is social in nature. Other App users may be able to view your profile within the App (which typically will contain your name and company) on a list of attendees at the meeting. The App allows users of the App (such as conference attendees and invitees) to interact with each other. All posts you make within the App (such as posting a status update, photo, or check-in) are visible to other attendees and invitees.

Administrative and Legal Reasons: Syngenta also may disclose data about you: (i) if Syngenta is required to do so by law or legal process, (ii) to law enforcement authorities or other government officials, or (iii) when Syngenta believes disclosure is necessary or appropriate to prevent physical harm or financial loss, or in connection with an investigation of suspected or actual fraudulent or illegal activity.

Affiliates and Business Transitions: Syngenta may transfer personal data to Syngenta affiliates for business and operational purposes. Syngenta also reserves the right to transfer personal data Syngenta has about you in the event Syngenta sells or transfers all or a portion of Syngenta’s business or assets (including in the event of a reorganization, dissolution, or liquidation). Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use personal information you have provided to Syngenta in a manner that is consistent with this Privacy Notice.

Your Rights and Choices

You may have certain rights under applicable law regarding the personal data we maintain about you. We offer you certain choices about what personal data we collect from you, how Syngenta uses that information, and how Syngenta communicates with you.

You can access your account by logging into your account profile in the App, where you can view or change your personal details. You can at any time tell Syngenta not to send you marketing communications by e-mail by clicking on the unsubscribe link within the marketing e-mails you receive from Syngenta. Syngenta will apply your preferences going forward. In some circumstances, withdrawing your consent to our use or disclosure of your personal data may mean that you cannot take advantage of certain products or services.

Where required by law, Syngenta obtains your prior opt-in consent at the time of collection for the processing of (i) personal data for marketing purposes and (ii) personal data deemed sensitive pursuant to applicable law.

Subject to applicable law, you may have the right to request access to and receive information about the personal data we maintain about you, update and correct inaccuracies in your personal data, and have the information blocked or deleted, as appropriate. The right to access personal information may be limited in some circumstances by local law requirements. To update your preferences, ask us to remove your information from our mailing lists or submit an access request, please contact us as specified in these terms and conditions.

How Syngenta Protects Personal Data

Syngenta maintains appropriate administrative, technical, and physical safeguards to protect personal data against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the personal data in Syngenta’s possession. Syngenta also take measures to destroy or permanently de-identify personal information when there is no longer a business need to keep the information. The types of measures we take vary with the type of information, and how it is collected and stored.

Please note that no collection or data transmission can be guaranteed to be 100% secure. Therefore, while Syngenta strives to protect your personal data, Syngenta does guarantee or warrant the security of any data transmission.

Syngenta will never ask you for your password in any unsolicited communication (including unsolicited correspondence, such as letters, phone calls, or e-mail messages). If you believe your user name and password have been compromised, please contact us by following the instructions provided in these terms and conditions.

Data Transfers

Syngenta may transfer personal information to countries other than the country in which the data was originally collected. These countries may not have the same data protection laws as the country in which you initially provided the information. When Syngenta transfers your personal information to other countries, Syngenta will protect that information as described in this Privacy Notice.

DISCLAIMER / LIABILITY:

USE OF THE APP IS AT YOUR OWN RISK. THE APP IS PROVIDED ON AN AS-IS BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW:

(A) SYNGENTA DISCLAIMS ALL LIABILITY WHATSOEVER, WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE IN RELATION TO THE APP; AND

(B) ALL IMPLIED WARRANTIES, TERMS (WHETHER IMPLIED BY STATUE, COMMON LAW OR OTHERWISE), INCLUDING (WITHOUT LIMITATION) ANY WARRANTY, TERM OR CONDITION AS TO ACCURACY, COMPLETENESS, SATISFACTORY QUALITY, PERFORMANCE, FITNESS FOR PURPOSE OR ANY SPECIAL PURPOSE, AVAILABILITY, NON INFRINGEMENT, INFORMATION ACCURACY, INTEROPERABILITY, QUIET ENJOYMENT AND TITLE ARE, AS BETWEEN SYNGENTA AND YOU, HEREBY EXCLUDED. IN PARTICULAR, BUT WITHOUT PREJUDICE TO THE FOREGOING, WE ACCEPT NO RESPONSIBILITY FOR ANY TECHNICAL FAILURE OF THE INTERNET AND/OR THE APP; OR ANY DAMAGE OR INJURY TO USERS OR THEIR EQUIPMENT AS A RESULT OF OR RELATING TO THEIR USE OF THE APP. YOUR STATUTORY RIGHTS ARE NOT AFFECTED.

Syngenta will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with the App, for any:

Economic loss (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or
Loss of goodwill or reputation; or
Special or indirect or consequential loss; or
Any losses due to your relying upon any information or content of the App.

IF SYNGENTA IS LIABLE TO YOU FOR ANY DIRECT CLAIMS OR DAMAGES IN RELATION TO THE APP, THAT LIABILITY (HOWSOEVER ARISING) SHALL BE LIMITED TO:

(A) Rs.100 (Rupees One Hundred only); OR

(B) THE SUMS PAID BY YOU UPON PURCHASING THE APP, OR ANY IN-APP SPEND, INCLUDING SUBSCRIPTIONS, WHICHEVER IS GREATER.
Nothing in these Terms shall be construed as excluding or limiting the liability of Syngenta or its group companies which cannot be excluded by the Applicable Laws.

SERVICE SUSPENSION:

Syngenta reserves the right to suspend or cease providing any services relating to the apps published by it, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.

ADVERTISES IN THE APP:

We accept no responsibility for adverts contained within the App. If you agree to purchase goods and/or services from any third party who advertises in the App, you do so at your own risk and peril without any liability to Syngenta, in the respect. The advertiser, not Syngenta, is responsible for such goods and/or services and if you have any queries or complaints in relation to them, your only recourse is against the advertiser.

COMPETITIONS:

If you take part in any Competition which is run in or through the App, you agree to be bound by the rules of that Competition and any other Rules specified by Syngenta from time to time and by the decisions of Syngenta, which are final in all matters relating to the Competition. Syngenta reserves the right to disqualify any entrant and/or winner in its absolute discretion without notice in accordance with the Competition Rules.

IN-APP VOUCHER CODES:

Any in-app voucher codes issued by Syngenta may only be used in accordance with our Terms and Conditions for in-app voucher codes.

GENERAL:

These Terms (as amended from time to time) constitute the entire agreement between you and Syngenta concerning your use of the App.

Syngenta reserves the right to update, modify or change these Terms from time to time. If it does so, the updated version will be effective immediately, and the current Terms may be available through a link in the App to this page. You are responsible for regularly reviewing these Terms so that you are aware of any updates/changes to the Terms and you will be bound by any new policy/policies upon your continued use of the App. These Terms shall be governed by and construed in accordance with Applicable laws and you agree to submit to the exclusive jurisdiction of the Courts at Pune. If any provision(s) of these Terms are held by a court of competent jurisdiction to be invalid or unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties (as reflected in the provision) and all other provisions shall remain in full force and effect.

Syngenta’s failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Syngenta in writing.
Unless otherwise expressly stated, nothing in the Terms shall create any rights or any other benefits whether pursuant to the Contracts Act 1972 or otherwise in favor of any person other than you, Syngenta and its group companies.
